1. Acceptance of Terms
Welcome to Radyo PH ("Radyo PH," "we," "our," or "us"), operated through radyoph.com and the Radyo PH Android application.
By accessing or using the Radyo PH website, Android application, or related services (collectively, the "Service"), you agree to these Terms & Conditions and our Privacy Policy.
If you do not agree with these Terms, please discontinue use of the Service.
Your use of certain third-party services accessible through Radyo PH may also be subject to the terms and policies of those third parties.
2. Description of the Service
Radyo PH is an online radio directory and streaming platform that provides convenient access to AM, FM, and online radio stations primarily serving the Philippines and Filipino communities worldwide.
The Service may include:
Live radio streaming
Radio station listings and information
Station search and discovery
User accounts
Saved and synchronized favorite stations
Station submission and correction requests
Error reporting
Push notifications
Advertising
Android Auto integration
Now-playing information, station artwork, and audio metadata
Other radio-related features that may be introduced from time to time
Unless expressly stated otherwise, Radyo PH does not own, operate, or control the third-party radio stations or streaming servers accessible through the Service.
Radio streams are provided by or originate from their respective broadcasters or streaming providers.
3. User Accounts
Some Radyo PH features may require a user account.
When creating or using an account, you agree to:
Provide accurate information to the best of your knowledge.
Maintain the security of your login credentials.
Not share, sell, transfer, or misuse your account.
Notify us if you believe your account has been compromised.
Use your account only for lawful purposes.
You are responsible for activity performed through your account unless the activity results from a security failure attributable to Radyo PH.
Passwords are not stored in plaintext and are handled as described in our Privacy Policy.
Account Deletion
You may request deletion of your account and associated server-side personal data by:
Using the Delete Account option in the Radyo PH app's Profile section; or
Contacting us at xcitemediaworxph@gmail.com from the email address associated with your account.
Account deletion is subject to any limited retention required for legitimate security, fraud-prevention, legal, or regulatory purposes, as described in our Privacy Policy.
4. Favorites and Account Synchronization
Radyo PH allows users to save favorite radio stations.
When you are not signed in, favorite station information may be stored locally on your device.
When you sign in to your Radyo PH account, supported favorite-station information may be synchronized with Radyo PH servers so that your favorites can be restored or accessed across supported devices and app reinstalls.
Synchronization may occur automatically while you are signed in.
Logging out stops account-based synchronization, although information already stored locally on your device may remain until you remove it, clear the app's data, or uninstall the application.

5. Station Submissions, Corrections, and Error Reports
Users may submit requests to add a station, correct station information, report a broken stream, or notify us of other issues.
When making a submission, you agree that:
The information you provide is accurate to the best of your knowledge.
You will not knowingly submit false, misleading, fraudulent, malicious, or unlawful information.
You will not impersonate a station owner, broadcaster, or representative.
If you claim to represent a station or submit material requiring authorization, you have the authority to do so.
You will not use automated systems to send excessive, duplicate, abusive, or spam submissions.
By submitting station information, you grant Radyo PH permission to use that information as reasonably necessary to review, verify, list, update, display, or manage the station within the Service.
A submission does not guarantee that a station will be added, updated, retained, or displayed.
Radyo PH may reject, modify, suspend, or remove a station listing when reasonably necessary, including for inaccurate information, unavailable streams, legal concerns, duplicate listings, security issues, or violations of these Terms.
Information associated with submissions and technical reports may be processed for abuse prevention and troubleshooting as described in our Privacy Policy.
6. Third-Party Radio Streams and Content
Radyo PH connects users to radio streams provided by third-party broadcasters and streaming servers.
We do not control and are not responsible for:
Stream availability or downtime
Buffering, latency, or connection quality
Audio quality or encoding
Programming schedules
Music, news, talk programs, commentary, or other broadcast content
Advertising inserted by the radio station or stream provider
Statements or opinions expressed by broadcasters
Changes to station stream URLs
Geographic or network restrictions imposed by a station
Third-party server practices
Responsibility for broadcast content remains with the applicable broadcaster, station operator, content provider, or rights holder.
Access to a particular station through Radyo PH does not imply ownership, sponsorship, endorsement, partnership, or affiliation between Radyo PH and that station unless expressly stated.
7. Stream Connections, Metadata, and Artwork
During live radio playback, the Radyo PH app may connect directly to third-party radio streaming servers.
Those servers may independently collect technical information, such as your IP address, according to their own systems and policies. Radyo PH does not control third-party streaming-server practices.
The Service may display information transmitted by a station or obtained through third-party services, including:
Station name
Program information
Song title
Artist
ICY/Shoutcast metadata
Station logos
Album or cover artwork
Radyo PH does not guarantee the accuracy, completeness, availability, or ownership status of metadata supplied by third parties.
Where supported, Radyo PH may query third-party services such as the Apple iTunes Search API to retrieve artwork associated with currently playing music.
8. Advertising
The Radyo PH Android application may display advertisements.
Advertising may be provided through services including:
Google AdMob
Google Ad Manager
Meta Audience Network
Other advertising providers that may be disclosed in our Privacy Policy
Advertising providers may process device information and advertising identifiers in accordance with their own privacy policies and applicable law.
Where consent is legally required for personalized advertising, Radyo PH may use a consent-management system such as Google's User Messaging Platform (UMP).
Users who decline or withdraw consent for personalized advertising may still receive non-personalized or contextual advertisements where permitted.

9. Analytics, Crash Reporting, Notifications, and App Integrity
The Radyo PH application may use third-party services to operate, secure, analyze, and improve the Service.
These services may include:
Firebase Analytics
Firebase Crashlytics
Firebase Cloud Messaging
Google Play Integrity API
These services may process technical information necessary for functions such as:
Understanding application usage
Diagnosing crashes and application errors
Delivering push notifications
Detecting abuse or manipulated applications
Improving application stability and functionality

10. Android Auto and Device Integration
Radyo PH may provide Android Auto functionality on compatible devices and vehicles.
When using Android Auto, the Service may provide information such as:
Station names
Station artwork
Playback controls
Now-playing information
Other playback metadata
The application may also use supported Android connectivity functions to maintain or evaluate the connection between your phone and the Android Auto system.
Compatibility and functionality depend on your Android device, vehicle, infotainment system, network connection, Android version, and third-party software.
Radyo PH does not guarantee compatibility with every vehicle, device, head unit, Android version, or Android Auto configuration.
11. Intellectual Property
Radio station names, trademarks, logos, audio programming, broadcast material, and other third-party content remain the property of their respective owners or rights holders.
Radyo PH does not claim ownership of third-party radio broadcasts merely because they are accessible through the Service.
Unless otherwise indicated, Radyo PH's own:
Branding
Website design
Application design
Original graphics
Original text
Databases and organization of station information
Software and other original materials
are owned by or licensed to Radyo PH/XCITE MEDIAWORX and are protected by applicable intellectual-property laws.
This does not apply to third-party software, libraries, trademarks, content, or open-source components used according to their respective licenses.
You may not reproduce, redistribute, commercially exploit, impersonate, or create unauthorized copies of Radyo PH's proprietary content or branding except with permission or as otherwise allowed by law.
12. User Responsibilities and Prohibited Conduct
By using Radyo PH, you agree not to:
Use the Service for unlawful purposes.
Attempt unauthorized access to accounts, servers, APIs, databases, or systems.
Hack, disrupt, overload, damage, or interfere with the Service.
Circumvent security, rate limits, access restrictions, or integrity protections.
Introduce malware, malicious code, or harmful automated traffic.
Create accounts using false identities for fraudulent or abusive purposes.
Abuse station-submission, reporting, registration, login, or other forms.
Scrape, harvest, reproduce, or systematically extract substantial portions of Radyo PH's database without authorization.
Attempt to obtain another user's credentials or private information.
Use Radyo PH in a manner that infringes another person's intellectual-property, privacy, or other legal rights.
Falsely represent an affiliation with Radyo PH or any listed radio station.
We may take reasonable technical or administrative measures to prevent misuse of the Service.
13. Suspension and Termination
Radyo PH may suspend or restrict access to an account or to certain features when reasonably necessary to:
Protect the Service or other users.
Investigate suspected fraud, abuse, or security incidents.
Address violations of these Terms.
Comply with legal obligations or valid legal requests.
Prevent excessive automated or malicious activity.
Where reasonably practicable, restrictions will be proportionate to the circumstances.
Users may stop using Radyo PH at any time and may delete their account as described in Section 3.
14. External Links and Third-Party Services
Radyo PH may contain links to third-party websites, social-media services, radio station websites, application stores, streaming servers, advertising providers, and other external services.
These third parties operate independently from Radyo PH.
We do not control and are not responsible for their:
Content
Availability
Security
Privacy practices
Terms of service
Products or services
Accessing a third-party website or service is subject to that provider's own terms and policies.

These Terms & Conditions and the Privacy Policy should be read together.
If there is a conflict concerning the collection, processing, retention, or protection of personal information, the Privacy Policy governs our handling of personal information, subject to applicable law.
16. Children's Use
Radyo PH is not directed at children under 13 years of age, or under the applicable minimum age for independent use of online services in the user's jurisdiction.
If you are below the applicable minimum age, you should not create a Radyo PH account or submit personal information through the Service.
If we become aware that personal information has been collected from a child contrary to applicable requirements, we may delete that information and any associated account.

17. Availability and Disclaimer of Warranties
Radyo PH is provided on an "as is" and "as available" basis to the extent permitted by applicable law.
We work to maintain the reliability and security of the Service, but we do not guarantee that:
Every radio station will always be available.
Streams will operate continuously or without interruption.
Station information or metadata will always be accurate or current.
The Service will be completely error-free.
Every feature will work on every device.
The Service will be free from temporary outages or technical problems.
Third-party services will remain available or unchanged.
Features, station listings, streams, interfaces, and supported integrations may change over time.
Nothing in these Terms excludes warranties, rights, or remedies that cannot legally be excluded under applicable law.
18. Limitation of Liability
To the maximum extent permitted by applicable law, Radyo PH, XCITE MEDIAWORX, and their operators shall not be liable for indirect, incidental, special, consequential, or similar losses arising from:
Unavailability of a third-party radio stream
Interruptions or technical failures
Inaccurate station information or metadata
Content broadcast by third-party stations
Actions of third-party websites, streaming servers, advertising providers, or services
Loss of locally stored settings or favorites
Unauthorized activity outside Radyo PH's reasonable control
Radyo PH does not assume responsibility for the editorial or broadcast content of independent radio stations merely because those stations are accessible through the Service.
Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded.
19. Content Removal and Rights-Holder Requests
Radyo PH respects the rights of broadcasters, station operators, trademark owners, copyright holders, and other rights holders.
If you believe that a station listing, logo, stream link, or other material accessible through Radyo PH infringes your rights or should not be listed, please contact us and provide sufficient information to identify:
The affected station or material
The rights or interest you claim
The specific listing, stream, logo, or content involved
Your contact information
Any supporting information reasonably necessary to evaluate the request
Valid requests will be reviewed and appropriate action may be taken, including correction, disabling, or removal of a listing or link.
20. Changes to the Service
Radyo PH may add, modify, suspend, replace, or discontinue features of the Service from time to time.
This may include changes to:
Station listings
Account functionality
Favorites synchronization
Advertising systems
APIs
Android Auto integration
Supported devices
Third-party service integrations
User-interface features
We are not required to maintain any particular feature indefinitely.
Where a change materially affects the handling of personal information, our Privacy Policy and applicable notice or consent requirements will apply.
21. Changes to These Terms
We may update these Terms & Conditions from time to time to reflect:

Changes in our operations
Security requirements
Third-party service changes
Legal or regulatory requirements

When these Terms are updated, we will publish the revised version and update the Effective Date.

22. Governing Law
These Terms & Conditions are governed by and interpreted in accordance with the laws of the Republic of the Philippines, without prejudice to any mandatory rights available to users under applicable consumer, privacy, or other laws.
23. Severability
If any provision of these Terms is determined by a court or competent authority to be invalid, unlawful, or unenforceable, that provision will be applied or limited to the extent permitted by law.
The remaining provisions will continue in effect.
24. No Waiver
Failure by Radyo PH to enforce a provision of these Terms in a particular instance does not constitute a waiver of that provision or of our right to enforce it in the future.
